Please read these Terms and Conditions of Participation in the Libran Beauty Rewards Program carefully. By participating in this program, you agree to be bound by the Terms described herein and all Terms incorporated by reference. If you do not agree to all of these terms, contact us at support@libranbeauty.com to explicitly declare that you decline to participate in the Libran Beauty Rewards Program. Upon receipt of your declaration to decline to participate, all accrued points in your account are void.

 

General Terms

 

The Libran Beauty Rewards Program (“Rewards Program”) is offered at the sole discretion of Libran Beauty (“Libran Beauty,” “we,” “our” or “us”). By participating in the Rewards Program, you (individually and collectively, “you,” “your,” or “Member”), agree that you have read, understood and agree to be bound by these Rewards Program Terms and Conditions of Participation (“Rewards Program Terms” or “Terms”) and by any changes or modifications we may make.

 

Changes to Terms

 

We reserve the right to change or modify these Terms or any policy, FAQ, or guideline pertaining to the Rewards Program, in whole or in part, at any time and in our sole discretion. You should review these Rewards Program Terms and the related policies and FAQs frequently to understand the terms and conditions that apply to the Rewards Program as they may change from time to time. These Rewards Program Terms do not alter in any way the terms or conditions of any other agreement you may have with us, including any agreement for other services. By participating in the Rewards Program you also agree to be bound by our website Privacy Policy and our Site Terms of Use, which are incorporated herein by reference. If you do not agree to these Rewards Program Terms, our website Privacy Policy, and our Site Terms of Use, you cannot participate in the Rewards Program. The Rewards Program is void where prohibited by law.

 

Personal Use

 

The Rewards Program is intended for personal use only. The Rewards Program is not targeted towards, nor intended for use by, anyone under the age of 13. If you are between the ages of 13 and 18, you may access and participate in the Rewards Program only under the supervision of a parent or legal guardian who agrees to be bound by these Terms.
 

Program Enrollment

 

Eligible individuals who complete a service with Libran Beauty are automatically enrolled in the Rewards Program and immediately begin earning Libran Beauty Points toward their Rewards Program account. Only one (1) Rewards Program account may be associated with a single member, a single email address, and single phone number.

 

How the Rewards Program Works

 

The Rewards Program is a way in which we reward and thank our dedicated customers for purchasing our services and for participating in certain Libran Beauty Rewards Program activities. You are able to earn rewards by completing Libran Beauty appointments or taking certain other qualifying Rewards Program actions. Points earned can then be exchanged for Rewards Program Redeemable Dollar Credits (“credits”). Opportunities to earn rewards and points will be posted on the Site or may be published through other media (e.g., in studio print ads, social media, etc.).Visit our FAQs to learn more about earning rewards.

 

Redeeming Rewards Program Redeemable Dollar Credits (“Credits”)

 

Credits are determined by the number of points a member has earned through the purchase of Libran Beauty services and through qualifying activities, beginning on the date when a member first completes a Libran Beauty service.

 

The threshold for redeemable credit is: 

 

100 points = $3 credit toward future appointments

200 points = $6 credit toward future appointments

300 points = $9 credit toward future appointments

 

To receive redeemable credits, you must accrue a minimum of one hundred (100) points. Credits are only redeemable in increments of three (3) as illustrated above.

 

Rewards Program credits can only be redeemed on site at our studio.

 

Earning Rewards Program Points and Credits

 

You earn a set number of points through the purchase of Libran Beauty services and through qualifying activities, beginning on the date when you complete your first Libran Beauty service.

 

All Libran Beauty services listed on our website are eligible purchases that provide you opportunities to earn points. Please see our services page for a list of eligible services.

 

In addition, participating in the following activities will also provide you opportunities to earn rewards: (1) Complete a Libran Beauty Service. You earn points for every Libran Beauty service you complete; (2) Book your next appointment in-studio without canceling or rescheduling. Book your next appointment with Libran Beauty and show up for that scheduled appointment without canceling or rescheduling; (3) Refer a friend or a family member. Refer a friend or a family member to Libran Beauty and earn referral points every time they complete a Libran Beauty service (4) Celebrate your birthday. As an active member of the Libran Beauty community, every year you celebrate your birthday, you earn rewards. You will not receive points for activities that are not otherwise outlined in this section.

Completing a Libran Beauty Service

 

To complete a Libran Beauty service, your service must meet the following criteria: (1) The service must be listed in our services menu; (2) The full balance of the service must be paid in full either through our website or in-person. Deposits DO NOT constitute full balance payments.

 

Book Your Next Appointment In-Studio

 

Book your next appointment in-studio happens when you book your next appointment with Libran Beauty immediately after completing your service. Bookings that occur 30 minutes after completing your appointment do not qualify.

 

To earn the reward associated with this activity, your in-studio booking must meet the following criteria: (1) The booking must occur within 30 minutes of completing your service; (2) You must show up for that scheduled appointment without canceling or rescheduling. 

 

If any one of these criteria is not met, you may NOT earn the associated 10% discount reward. In addition, this reward cannot be combined with the Celebrate Your Birthday reward.

 

Celebrate Your Birthday Reward

 

Every year you celebrate your birthday with us you'll receive 25% off one service on the month of your birthday. The discount will automatically be applied to the first appointment you complete on the month of your birthday.

 

The Celebrate Your Birthday Reward DOES EXPIRE. The discount associated with this rewards activity is only valid only on the month of your birthday; no extensions. In addition, this reward is only valid for one service on the month of your birthday; no exception. This reward discount can only be applied once a year and cannot be combined with any future offers or promotions.

 

Point Expiration

 

Earned Points. Earned points do not expire and can be rolled over to the next year. Earned Points are defined by points earned through the purchase of Libran Beauty services and through qualifying activities mentioned above.

 

Gifted Points. Gifted points do not expire and can be rolled over to the next year. Gifted points are defined as points given to you from Libran Beauty as a gift and has been explicitly described as a gift by Libran Beauty.

 

Promotional Points. Promotional points do expire. The expiration date for promotional points are determined on a case by case basis and will be explicitly labeled as promotional points.

 

Cash Value of Rewards Program Points and Credits

 

Points and credits earned through the Rewards Program have no cash value, are non-transferable, and you have no property rights in or to credits or other Rewards Program benefits. Credits cannot be exchanged or returned for points or a monetary refund. Credits cannot be used toward gratuity payments. In addition, your redemption of credits accrued in connection with the Rewards Program cannot be combined with any other offers or discounts, unless otherwise expressly indicated by Libran Beauty.

 

We reserve the right to change Rewards Program benefits, how you reach the Rewards Program credit threshold, how you earn points and how we evaluate and reward your eligible purchases and/or other Rewards Program activity. We reserve the right to place limits on the number of purchases or activities that are eligible for the Rewards Program and/or for any given credit threshold or point level, the number or types of points or credits you may receive or earn in a given time period or for the duration of the Rewards Program and/or any combination thereof.

 

If you have concerns that a purchase or other activity was not properly applied to your account, you should contact us at support@libranbeauty.com. Your email must specify your name and email address associated with the Rewards Program, the date of the Rewards Program activity, and the issue(s) you encountered. This email must be sent no more than thirty-five (35) days after the date the eligible service purchase or other Rewards Program activity took place. We are not responsible for late notifications about service purchases or other Rewards Program activities not being credited to an account.

 

Marketing Communications

 

By enrolling in the Rewards Program you will automatically receive Rewards Program-related emails, including Rewards Program marketing emails and information about your Libran Beauty Rewards Program account, points and credits.

 

You may opt-out of receiving Libran Beauty marketing emails at any time by following the instructions provided in the email or as otherwise provided in our Privacy Policy, but operational emails will still be sent to you as they relate to your participation in the Rewards Program. Examples of these include, but are not limited to, a redemption confirmation email, a new points acquisition email, a profile update email, or other communications that relate to your account. If you terminate your Rewards Program account, you will no longer receive Rewards Program-related communications. If you opt-out of Rewards Program-related marketing emails, you will no longer receive emails regarding the Rewards Program points or credits that may be available to you.

 

Termination and Modification

 

Without notice to you, Libran Beauty reserves the right to suspend any Rewards Program account and/or terminate your account and/or your participation in the Rewards Program if Libran Beauty determines, in its sole discretion, that you have violated these Terms or that the use of your Rewards Program account is unauthorized, deceptive, fraudulent or otherwise unlawful. In the event that your participation in the Rewards Program is terminated, all accrued points in your account are void.

 

Without notice to you, Libran Beauty also reserves the right to "unregister" and make ineligible for the Rewards Program, all accounts that have been inactive for two (2) consecutive years. Inactivity is defined as no points earned from completing a service during such two (2) consecutive year periods. Points earned from the Activity category do not count as points earned from completing a service. In the event that your Rewards Program account is unregistered or rendered inactive, all accrued points in your account are void.

 

Libran Beauty reserves the right to change, modify, discontinue or cancel the Rewards Program or any part of the Rewards Program, at any time and in its sole discretion, without notice to you.

 

If you decide you no longer want to be a part of the Rewards Program you may cancel your account at any time by contacting us at support@libranbeauty.com to confirm that you decline to participate in the Libran Beauty Rewards Program. Upon receipt of your request to cancel your Rewards Program account, all accrued points in your account are void.

 

If you have a dispute with us or are dissatisfied with the Rewards Program, termination of your account in the Rewards Program is your sole remedy. We have no other obligation, liability, or responsibility to you.

 

Limitation of Liability

 

IN NO EVENT SHALL WE BE LIABLE TO YOU OR ANY THIRD PARTY FOR CONSEQUENTIAL, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR ENHANCED DAMAGES, LOST PROFITS OR REVENUES OR DIMINUTION IN VALUE, ARISING OUT OF, OR RELATING TO, AND/OR IN CONNECTION WITH ANY BREACH OF THESE TERMS, REGARDLESS OF (A) WHETHER SUCH DAMAGES WERE FORESEEABLE, (B) WHETHER OR NOT WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND (C) THE LEGAL OR EQUITABLE THEORY (CONTRACT, TORT OR OTHERWISE) UPON WHICH THE CLAIM IS BASED.

 

OUR SOLE AND ENTIRE MAXIMUM LIABILITY, FOR ANY REASON, AND YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY CAUSE WHATSOEVER, SHALL BE LIMITED TO THE ACTUAL AMOUNT PAID BY YOU FOR THE SERVICES YOU HAVE BOOKED THROUGH OUR WEBSITE AND AT OUR STUDIO LOCATION.

 

The limitation of liability set forth above shall only apply to the extent permitted by law.

 

Indemnification

 

You agree to defend, indemnify and hold us, our parents, subsidiaries, affiliates, partners, licensor's, officers, directors, employees, and agents harmless for any loss, damages or costs, including reasonable attorneys' fees, resulting from any third party claim, action, or demand resulting from your participation in the Rewards Program or your breach of any of these Rewards Program Terms.

 

Privacy

 

We respect your privacy and are committed to protecting it. Our Privacy Policy governs the processing of all personal data collected from you in connection with your purchase of products or services through the Site.

 

Force Majeure

 

We will not be liable or responsible to you, nor be deemed to have defaulted or breached these Terms, for any failure or delay in our performance under these Rewards Program Terms of Participation when and to the extent such failure or delay is caused by or results from acts or circumstances beyond our reasonable control, including, without limitation, acts of God, flood, fire, earthquake, explosion, governmental actions, war, invasion or hostilities (whether war is declared or not), terrorist threats or acts, riot or other civil unrest, national emergency, revolution, insurrection, epidemic, lockouts, strikes or other labor disputes (whether or not relating to our workforce), or restraints or delays affecting carriers or inability or delay in obtaining supplies of adequate or suitable materials, materials or telecommunication breakdown or power outage.

 

Governing Law and Jurisdiction

 

The formation, interpretation, and performance of this Agreement and any disputes arising out of it shall be governed by the substantive and procedural laws of the State of California without regard to its rules on conflicts or choice of law and, to the extent applicable, the laws of the United States. The exclusive jurisdiction and venue for actions related to the subject matter hereof shall be the courts located in the State of California, and you hereby submit to the personal jurisdiction of such courts. You hereby waive any right to a jury trial in any proceeding arising out of or related to this Agreement. The United Nations Convention on Contracts for the International Sale of Goods does not apply to this Agreement.

 

Severability

 

If any provision or part of a provision of these Rewards Program Terms is unlawful, void or unenforceable, that provision or part of the provision is deemed severable from these Rewards Program Terms and does not affect the validity and enforceability of any remaining provisions.

 

No Third-Party Beneficiaries

 

These Rewards Program Terms do not and are not intended to confer any rights or remedies upon any person other than you.
